Concession Theory of Corporate Personality

Theory
Concession Theory of Corporate Personality
Jurist
Otto von Gierke
Description

Holds that a corporation has legal personality only because the State concedes it — juristic personhood is a privilege granted by sovereign authority, not an inherent right. Closely allied to the Fiction Theory and used to justify State control over incorporation, it argues against the view that group personality exists naturally or independently of the law.
