Prediction Theory of Law

Theory
Prediction Theory of Law
Jurist
Oliver Wendell Holmes Jr.
Description

Holmes argued that law is nothing more than a prediction of what courts will actually do in fact — viewed through the eyes of the "bad man" who cares only about consequences, not morality. It rejects abstract moral or natural-law definitions and builds the foundation of American Realism.
