Fiction Theory of Corporate Personality

Fiction Theory of Corporate Personality
Jurist
Friedrich Carl von Savigny
Description

Holds that a corporation has no real personality of its own; its legal personality is an artificial fiction created and attributed by the State/law for convenience, distinct from its members. It builds on the idea that only human beings are real persons, and argues against the Realist (organic) theory which treats corporations as having a genuine existence.
